If you have ever wondered what “damages caps” are and how they factor in to litigation, then read on. Two families in a joint case against Virginia Tech are learning the meaning of damages caps firsthand. The families brought wrongful death suits against Virginia Tech –and won, for the loss of their children who were attending class that fateful morning when gunfire from a crazed student broke out, killing 33.
The jury in the case heard evidence from lawyers at the firm representing both families, and from counsel representing the state of Virginia on behalf of the state university. Ultimately, they decided in favor of the plaintiffs, who asserted that the university should have taken the default position of evacuating the entire campus immediately after it discovered the first two victims shot to death in their dorm rooms.
